Digital Millennium Copyright Act (DMCA) Policy

Moe Bros Lending (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of MoeBrosLending.com (the “Site”) to do the same. Pursuant to the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our Site if such claims are reported to our designated DMCA Agent as outlined below.

1. Reporting Copyright Infringement

If you believe that material on our Site infringes upon your copyright, you may submit a written DMCA Takedown Notice to our designated agent, including the following required information:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Identification of the copyrighted work you claim has been infringed, or, if multiple works are involved, a representative list of such works.

Identification of the material that is allegedly infringing and where it is located on the Site (include URL or screenshot if possible).

Your name, mailing address, telephone number, and email address so we can contact you.

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.

2. Removal of Content

Upon receiving a valid DMCA Takedown Notice, we will:

Investigate the complaint

Remove or disable access to the allegedly infringing content

Notify the user responsible for the content (if applicable)

We reserve the right to terminate the access of users who are repeat infringers.

3. Submitting a Counter-Notice

If you believe content you posted on our Site was removed in error or misidentification, you may file a DMCA Counter-Notice with our DMCA Agent, including:

Your physical or electronic signature

Identification of the material removed and its prior location

A statement under penalty of perjury that you have a good faith belief the material was removed due to a mistake or misidentification

Your name, address, phone number, and email

A statement consenting to the jurisdiction of the federal court in St. Louis County, Missouri, and that you will accept service of process from the person who submitted the original DMCA notice

If a valid counter-notice is received, we may restore the content at our discretion, unless the original claimant files a court action.

4. Repeat Infringer Policy

Moe Bros Lending may, in its sole discretion, terminate access to the Site for users who are found to be repeat infringers, or who violate the intellectual property rights of others, regardless of the validity of individual claims.
